Welcome to the Terms and Conditions of writhentic. This document explains how you may use our services and what you can expect from us.
These Terms and Conditions govern the use of the Service, access to writhentic, and any other related contractual or legal relationship with the Provider.
Defined terms are listed in the relevant section of this document. Users are encouraged to read this document carefully.
Although the contractual relationship concerning the Products exists solely between the User and the Provider, the User acknowledges and agrees that Apple may enforce these Terms and Conditions as a third-party beneficiary if writhentic has been obtained through the Apple App Store.
These Terms and Conditions do not create any employment, agency, or partnership relationship between the parties.

Information about writhentic
The writhentic app helps users consciously reflect on personal situations and behaviors, act more authentically, and develop new patterns of thinking and behavior.
The app may only be used for private purposes. By using the app, you agree to these Terms and Conditions.
Further information about the processing of your personal data can be found in our Privacy Policy.
- Document situations: Users can quickly and easily record and reflect on personal situations.
- Analyze behavior: Situations can be evaluated with regard to authenticity, personal boundaries, or potential boundary violations.
- Develop new behaviors: Users can consciously formulate alternative reactions and practice future behavior.
- Visualize stress and authenticity: Entries and evaluations help identify patterns, stressful situations, and personal development.
Scope of writhentic
writhentic refers to this website, including its subdomains, as well as any other website through which the Provider makes the Service available.
writhentic also refers to applications for mobile phones, tablets, and other smart devices.

Terms of Use
Unless otherwise specified, the conditions set out in this section apply when accessing writhentic.
Specific or additional terms of use or access may apply in certain circumstances and, where applicable, will be expressly indicated in this document.
By using the Service, Users confirm that they meet the following requirements:
- Users must act as consumers.
- Users must not be located in a country that is subject to a United States government embargo or designated by the United States government as a "terrorist-supporting" country.
- Users must not appear on any United States government list of prohibited or restricted parties.
Content available through writhentic
Unless otherwise stated or clearly recognizable, all content available through writhentic is owned by the Provider or its licensors.
The Provider makes every reasonable effort to ensure that the content available through writhentic does not infringe applicable laws or third-party rights. However, this cannot always be guaranteed.
In such cases, Users are encouraged to contact the Provider using the contact details provided in this document. This does not affect any right to pursue legal or other remedies.
Rights relating to content available through writhentic
All rights to the content are reserved by the Provider.
Users may use the content only to the extent necessary for the proper use of the Service or as expressly permitted under these Terms and Conditions.
In particular, Users may not copy, download, distribute beyond the intended use, modify, translate, adapt, publish, transmit, sell, sublicense, or otherwise exploit any content without the Provider's prior express consent.
Access to external resources
Through writhentic, Users may have access to external resources provided by third parties.
Users acknowledge and agree that the Provider has no control over such external resources and is therefore not responsible for their content or availability.
The conditions governing third-party resources and any rights granted to use them are determined by the respective third party or, where applicable, by the relevant statutory provisions.
Acceptable use
writhentic and the Service may only be used for their intended purpose and in accordance with these Terms and Conditions and all applicable laws.
Users are solely responsible for ensuring that their access to and use of writhentic does not violate any applicable laws, regulations, or third-party rights.
Accordingly, the Provider reserves the right to take any appropriate measures to protect its legitimate interests, including denying Users access to writhentic or the Service, terminating agreements, or reporting unlawful activities carried out through writhentic or the Service to the competent authorities whenever Users are found or reasonably suspected to have:
- violated applicable laws, regulations, or these Terms and Conditions;
- infringed the rights of third parties;
- significantly harmed the Provider's legitimate interests;
- insulted or otherwise harmed the Provider or any third party.
Software license
All rights relating to the software and technical solutions on which writhentic is based, or which are embedded in or connected with it, remain the exclusive property of the Provider and/or its licensors.
Provided that Users comply with these Terms and Conditions, and notwithstanding any conflicting provision herein, the Provider grants Users a limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to use the software and any related technical solutions solely as required for the intended use of the Service.
Users are not granted any right to access, use, or distribute the source code. All rights relating to the processes, algorithms, and technical solutions contained in the software and related documentation remain exclusively with the Provider or its licensors.
All licenses and usage rights automatically terminate upon termination of the Agreement, regardless of the reason.
Users may download, install, run, and use the software on an unlimited number of devices, provided that such devices comply with current technical and market standards.
The Provider may release updates, bug fixes, and enhancements for writhentic and/or its related software. Users may be required to install such updates in order to continue using writhentic.
Access to entirely new versions or releases of the software may require the purchase of a separate license.
Upon expiration of the applicable license, Users must immediately delete all copies of the software.
Sales Terms
Paid Products
Some of the Products available through writhentic as part of the Service are provided for a fee.
Prices, subscription periods, and other conditions applicable to such Products are described below. Additional information is available on writhentic and in the relevant sections thereof.
Product description
Prices, descriptions, and availability of Products are displayed in the relevant sections of writhentic and may be changed without prior notice.
Although Products are presented with the greatest possible technical accuracy, any representation, including graphics, images, colors, or sounds, is provided for reference purposes only and does not constitute a guarantee regarding the characteristics of the purchased Product.
The characteristics of the selected Product are explained during the purchasing process.
Purchasing process
All steps from selecting a Product to submitting an order form part of the purchasing process.
The purchasing process includes, in particular, the following steps:
- Users select the desired Product.
- Users review their selection and may modify it at any time before completing the purchase.
- By confirming the purchase, Users submit a binding order.
Submission of the order
Once an order has been submitted, the following applies:
Submitting an order constitutes the conclusion of a contract and obliges the User to pay the stated price together with any applicable taxes and additional charges.
Where the purchased Product requires action by the User, such as providing personal information or special requests, the User undertakes to provide complete and accurate information.
After the order has been received, Users will receive an order confirmation.
Prices
During the purchasing process and before submitting the order, Users are informed of all applicable fees, taxes, and other charges.

Payment methods
Information about accepted payment methods is provided during the purchasing process.
Certain payment methods may be subject to additional terms or fees imposed by the relevant payment service provider.
The Provider does not collect or store complete payment information. Such information is processed exclusively by the relevant payment service provider.
Purchases through the Apple App Store
writhentic is distributed through the Apple App Store. Purchases, in-app purchases, and subscriptions are processed exclusively through Apple's payment system.
Apple's applicable terms and payment conditions also apply.
The Provider receives only the information required to administer purchases, subscriptions, and legal obligations.
Retention of ownership
Until full payment has been received, the ordered Products remain the property of the Provider to the extent permitted by applicable law.
Reservation of usage rights
Users do not acquire the right to use the purchased Product until the Provider has received payment in full.
Delivery of digital content
Digital content is made available to Users after successful completion of the purchasing process through the functionality provided by writhentic.
In order to use digital content, Users must satisfy the technical requirements specified by the Provider.
Term and termination
Subscriptions
Subscriptions grant Users continuous or recurring access to a Product for a specified period.
Details regarding the subscription period, features, and price are displayed before the purchase is completed.
Fixed-term subscriptions
Paid subscriptions become effective on the date the Provider receives payment.
Users are responsible for keeping their subscription details and payment method up to date.
The subscription automatically expires at the end of the agreed subscription period unless it is expressly renewed or extended.
Recurring subscriptions
Recurring subscriptions become effective on the date payment is received.
They automatically renew for the selected subscription period unless cancelled before renewal.
Cancellation becomes effective at the end of the current billing period.
Cancellation of recurring subscriptions
Recurring subscriptions may be cancelled at any time before the next renewal date.
Once the cancellation becomes effective, access to paid features ends upon expiration of the already paid subscription period.
Cancellation through Apple
If the subscription was purchased through the Apple App Store, cancellation must be carried out through the User's Apple ID account settings.
The Provider is unable to cancel Apple subscriptions on behalf of Users.
Any refunds are subject exclusively to Apple's applicable refund policies.
Changes to digital Products
The Provider reserves the right to modify, update, or further develop digital Products, provided that the contractual conformity of the Product is maintained.
Where required by applicable law, Users will be informed of material changes.
Provision of personal data
The provision of certain Products may require Users to provide personal data.
Further information regarding the processing of personal data is available in the writhentic Privacy Policy.
User rights
Right of withdrawal
Unless excluded by applicable law, Consumers are entitled to a statutory right of withdrawal.
Details regarding the conditions, deadlines, and legal consequences of withdrawal are governed by the applicable consumer protection laws.
Exclusion of the right of withdrawal
The right of withdrawal may expire, in particular in relation to digital content, if the User has expressly agreed that performance shall begin before the withdrawal period expires and has simultaneously acknowledged that this results in the loss of the right of withdrawal.
This applies only where such exclusion is permitted under applicable law.
Statutory warranties
Statutory warranty under EU law
Users acting as Consumers within the European Economic Area benefit from the statutory warranty rights applicable to digital Products under the relevant laws.
Statutory warranty in the United Kingdom
Users whose habitual residence is in the United Kingdom benefit from the statutory consumer rights provided under UK law.
Statutory warranty in Brazil
Users whose habitual residence is in Brazil benefit from the mandatory statutory warranty rights provided under Brazilian consumer law.
Statutory warranty in Switzerland
Users whose habitual residence is in Switzerland benefit from the applicable mandatory provisions of Swiss law.
Liability and indemnification
Indemnification
To the extent permitted by applicable law, Users agree to indemnify and hold harmless the Provider and its affiliates, officers, directors, employees, representatives, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising out of the User's breach of these Terms and Conditions, applicable law, or the rights of any third party.
Limitation of liability
To the extent permitted by applicable law, the Provider shall only be liable for damages caused intentionally or by gross negligence.
In the event of a slightly negligent breach of essential contractual obligations, the Provider's liability shall be limited to the typical and foreseeable damage.
The above limitations of liability shall not apply in cases involving injury to life, body, or health, or wherever liability cannot be excluded under mandatory law.
Liability for technical availability
The Provider strives to ensure a high level of availability of writhentic.
Temporary interruptions or restrictions caused by maintenance, technical failures, security measures, or circumstances beyond the Provider's reasonable control may nevertheless occur and, to the extent permitted by law, shall not give rise to any claims for damages.
Liability for content
The content provided through writhentic is intended solely for informational and personal reflection purposes.
It does not constitute medical, psychological, therapeutic, legal, or tax advice and is not intended to replace professional advice or treatment.
Common provisions
No waiver
The Provider's failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
Service interruption
The Provider may temporarily suspend the Service in order to carry out maintenance, system updates, or other technical measures.
Whenever reasonably possible, Users will be informed in advance of planned interruptions.
Resale of the Service
Users may not reproduce, sell, resell, license, or otherwise commercially exploit writhentic or any part of the Service without the Provider's prior written consent.
Privacy Policy
Information regarding the processing of personal data is available in the writhentic Privacy Policy, which forms an integral part of the overall framework governing the Service.
Intellectual property rights
All trademarks, logos, graphics, text, software components, and all other content available through writhentic are protected by copyright and other applicable intellectual property laws.
Any use beyond that expressly permitted under these Terms and Conditions requires the Provider's prior written consent.
Changes to these Terms and Conditions
The Provider reserves the right to amend or modify these Terms and Conditions at any time.
Changes will be published in an appropriate manner. Where required by applicable law, Users will be informed of material changes.
Assignment
The Provider may assign its rights and obligations under these Terms and Conditions in accordance with applicable law.
Users may assign their rights or obligations only with the Provider's prior written consent.

All communications relating to the use of writhentic should be sent using the contact details provided in these Terms and Conditions.
Severability
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
For Users in the European Union
The invalid provision shall be replaced by the legally permissible provision that most closely reflects its intended economic purpose.
Governing law and jurisdiction
Governing law
These Terms and Conditions shall be governed by the laws of the country in which the Provider is established, excluding its conflict of law rules.
The Provider's address is set out in the relevant section of these Terms and Conditions.
Mandatory consumer protection rules
Where the laws of the country in which a User has their habitual residence provide for a higher level of consumer protection, such mandatory provisions shall prevail.
Special provisions for Consumers in Switzerland
Where a User is a Consumer habitually resident in Switzerland, Swiss law shall apply.
Special provisions for Consumers in Brazil
Where a User is a Consumer in Brazil and the Product or Service is offered in Brazil, Brazilian law shall apply.
Jurisdiction
Any disputes arising out of or in connection with these Terms and Conditions shall generally be subject to the jurisdiction of the courts at the Provider's registered office.
European Consumers
This jurisdiction clause does not apply to Users acting as Consumers within the European Union. The same applies to Consumers in the United Kingdom, Switzerland, Norway, or Iceland wherever mandatory legal provisions provide otherwise.
Brazilian Consumers
The above jurisdiction clause does not apply to Users in Brazil to the extent that they qualify as Consumers.
Consumers in general
Mandatory statutory rules on jurisdiction applicable to Consumers remain unaffected.
Consumers in the United Kingdom
Consumers residing in England or Wales may bring proceedings before the courts of England and Wales.
Consumers residing in Scotland may bring proceedings before the courts of Scotland or England.
Consumers residing in Northern Ireland may bring proceedings before the courts of Northern Ireland or England.
Dispute resolution
Amicable dispute resolution
Users may contact the Provider with any questions or complaints. The Provider will make reasonable efforts to resolve disputes amicably and out of court.
Definitions and legal references
writhentic
writhentic means the website, mobile application, and all related services through which the Provider makes the Service available.
Agreement
Agreement means any legally binding relationship between the Provider and the User governed by these Terms and Conditions.
Provider
Provider means the natural or legal person that makes writhentic available.
Service
Service means all features and services made available through writhentic.
Product
Product means any good or digital service made available through writhentic, whether free of charge or for a fee.
Digital Product
Digital Product means digital content or digital services made available to Users through writhentic.
User
User means any natural person using writhentic.
Consumer
Consumer means any natural person acting for purposes that are predominantly outside their trade, business, craft, or profession.
Europe
Unless expressly stated otherwise, references to Europe include the Member States of the European Union as well as the European Economic Area.
Switzerland
Switzerland means the Swiss Confederation.
Brazil
Brazil means the Federative Republic of Brazil.
United Kingdom
United Kingdom means England, Wales, Scotland, and Northern Ireland.
